Home Occupation for Gun Smith Services and Knife Sharpening
STAFF RECOMMENDATION
Staff recommends approval of the accessory use for a home occupation located at 2605 E
Lacewood Drive for Dave Freshwater, subject to the conditions outlined below.
APPLICATION SUMMARY
The applicant, Dave Freshwater, has requested approval for a home occupation to operate a gun
smith and knife sharpening business out of his home located at 2605 E Lacewood Drive,
Meridian, Idaho.
LOCATION
The property is located at 2605 E Lacewood Drive.
APPLICABLE CODE
The property is zoned R-4, which allows for a home occupation with written approval from the
Planning Director.
Section 11-4-3.21 of the Unified Development Code (UDC) for the City of Meridian lists
specific criteria for home occupations, which serve clients or have a nonresident employee:
A. In no way shall the home occupation cause the premises to differ from its residential
character in the appearance, lighting, signs, or in the emission of noise, fumes, odors,
vibrations, or electrical interference.
B. The home occupation shall be conducted entirely in the dwelling, and not more than
twenty-five percent (25%) of the gross floor area of said dwelling shall be used for a
home occupation or for storing goods associated with the home occupation. Materials
may be stored in an attached garage or storage area, provided it shall not reduce the
required off-street parking below the standard established for that district.
C. No activity connected to the home occupation or any storage of goods, materials, or
products connected with a home occupation shall be allowed in any detached accessory
structure.

D. The home occupation shall not have more than two (2) out -going pickups per day from a
common carrier.
E. The home occupation shall be conducted by the inhabitants of the dwelling, and no more
than one (1) nonresident employee shall be permitted.
F. The home occupation shall not serve as a headquarters or main office where employees
come to the site and are dispatched to other locations.
G. No retail sales shall be permitted from the dwelling except the sale of: 1') services or
items produced or fabricated on the premises as a result of the home occupation; or 2)
products secondarily related to the personal service aspect of the home occupation; or 3)
products sold online that are delivered to customers by mail.
H. Off-street parking shall be provided asset forth in UDC 11-3C-6, in addition to the
required off-street parking for the dwelling.
I. All visits by clients, customers, and/or employees shall occur between the hours of 8:00
a.m. and 8:00 p.m.
J. The home occupation shall only be allowed as an accessory use to an allowed residential
use.

This letter is to confirm that the Director approved the accessory use permit application you
submitted for a home occupation consisting of gunsmith/firearm services and knife sharpening
out of your home located at 2605 E Lacewood Drive.
Your approval of the subject application is conditioned upon ongoing compliance with the
standards for home occupations listed in Unified Development Code (UDC) 11 -4-3-21, including
but not limited to, the following:

If you fail to maintain compliance with the above standards or limitations your approval may be
revoked or modified by City Council in accord with UDC 11-1-11D.
The Applicant, Director, or a Party of Record may request City Council review of a decision of
the Director. All requests for review shall be filed in writing with the Planning Division of the
Community Development Department on or before June 25, 2015, within fifteen (15) days after
the written decision is issued, and contain the information listed in UDC 11 -5A -6B.
If City Council review of the decision is not requested, the action of the Director represents a
final decision on a land use application. You have the right to request a regulatory taking
analysis under Idaho Code 67-8003.

The Meridian Planning Division has reviewed an application to operate a home occupation for an
in-home gunsmith/firearm services and knife sharpening business located at 2605 E Lacewood
Drive. Based on the review we find that the application complies with the Unified Development
Code (UDC) Title 11, Chapter 4, Section 3-9. UDC 11-4-3-21 is available for review at:

The applicant, Director, or a party of record may appeal this decision or a condition of approval
by requesting City Council review of this decision within fifteen days after the written decision
is issued. All requests shall be filed in writing with the Planning Department no later than June

I am applying for an Accessory Use Permit for my residence located at 2605 E. Lacewood Dr. Meridian,
ID 83646. The purpose of this permit is to start a home based business in which I will be engaged in
selling firearms, performing light gunsmithing services and knife sharpening services. I am in the process
of obtaining my Federal Firearms License which will permit the sale and gunsmithing of firearms.
I also will be selling services and firearm accessories online via a website and social media.
The area of my home that I intend to use for business purposes is approximately the back half of my 3rd
car attached garage for repairs and smithing/sharpening services and approximately 1/2 of the office in
my home for administrative work.

STANDARDS FOR HOME OCCUPATIONS
STATEMENT OF COMPLIANCE
UDC 11-4-3.21; Home Occupation: The following standards apply to all home occupation uses with the exception
that strict adherence to the standards contained in sections 11-4-3.21B, 11-4-3.21C, 11-4-3.21E, and 11-4-3.21F in
the TN -C and TN -R Districts is not required:
A. In no way shall the home occupation cause the premises to differ from its residential character in the
appearance, lighting, signs, or in the emission of noise, fumes, odors, vibrations, or electrical interference.
B. The home occupation shall be conducted entirely in the dwelling, and not more than twenty-five percent
(25%) of the gross floor area of said dwelling shall be used for a home occupation or for storing goods
associated with the home occupation. Materials may be stored in an attached garage or storage area,
provided it shall not reduce the required off-street parking below the standard established for that district.
C. No activity connected to the home occupation or any storage of goods, materials, or products connected
with a home occupation shall be allowed in any detached accessory structure.
D. (Rep. by Ord. 07-1325, 7-10-2007).
E. The home occupation shall not have more than two (2) out -going pickups per day from a common carrier.
F. The home occupation shall be conducted by the inhabitants of the dwelling, and no more than one (1)
nonresident employee shall be permitted.
G. The home occupation shall not serve as a headquarters or main office where employees come to the site
and are dispatched to other locations.
H. No retail sales shall be permitted from the dwelling except the sale of: 1) services or items produced or
fabricated on the premises as a result of the home occupation; or 2) products secondarily related to the
personal service aspect of the home occupation; or 3) products sold online that are delivered to customers
by mail.
Off-street parking shall be provided as Section 11-3C-6 of this Title, in addition to the required off-street
parking for the dwelling.
All visits by clients, customers, and/or employees shall occur between the hours of 8:00 a.m. and 8;00 p.m.
K. The home occupation shall only be allowed as an accessory use to an allowed residential use.
Certification:
I have read and understand the above standards for the operation of a home occupation and certify that I will
conduct my business in accordance with these standards. If I cannot meet these standards, I am not allowed this
accessory use.

Thank you C. Jay,
I understand that you can't sell retail from your home. My business is a combination of knife/tool sharpening,
gunsmithing and gun transfer sales. Any gun sales will be via internet sales. While the FFL license permits me to make
sales directly to the customer, I will not be selling firearms from my home. There will be no advertising, gun sales
customers, etc. I will be doing some light gunsmithing from my residence where a firearm is shipped to me, or picked up
by me and returned via mail or in person. The other part of this venture is for FFL transfers. When a customer purchases
a firearm from a retail or internet sales, they have to have that firearm transferred to a FFL holder in the state they
reside. I then would do the required 4473 form, check background and complete transfer to the individual. The sale of
the firearm was already completed, I would just be doing the transfer. So, that is the firearms part of my business. The
other half or more will be tool, knife, scissor sharpening, etc. I probably will have people drop off items that need to be
sharpened as I don't think the internet will be as effective for this portion.
So, my understanding as far as the ATF is concerned that my FFL permit would allow face to face sales, transfers,
internet sales via mail and gunsmithing. I will not be selling firearms out of my home. My intent on firearm sales is via
the internet and mail, which I predict to be a very small portion of sales, the majority of my firearms business will be FFL
transfers and gunsmithing. The larger picture would be sharpening and smithing. The City of Meridian is welcome to
make unannounced visits to ensure I am complying with city code on that issue.
There are several other Meridian residents that have a FFL license. I'm curious how this process was completed for
them.

Dave,
I wanted to give you an update on your permit application. I have some question for ATF before we can issue the permit.
I have been speaking with them, but there are still some outstanding questions that are getting answered at this point.
We don't usually see retail sales as a component of an accessory use permit, so I haven't been as familiar with that part
of the code. It does say that "no retail sales shall be permitted from the dwelling except for the sale of: 1) services or
items produced or fabricated on the premises as a result of the home occupation: or 2) products sold secondarily related
to the personal service aspect of the home occupation; or 3) products sold online that are delivered to customers by
mail." This would prohibit the firearms from being sold via retail from the home. Given this, I am trying to determine
from ATF exactly what your permit from them would allow AND what they require you be able to do from your home
(i.e. do they require that customers must purchase the firearms from your home, person to person, via retail on site?).
You can accept customers with our permit, but you cannot advertise that you are selling firearms from your home and
customers cannot simply show up at your home expecting to purchase firearms.
I will continue to work through this with ATF. However, I wanted to give you an update because I will be out of the office
tomorrow and my hope was to get this wrapped up for you this week, but I'm not sure that will happen. Let me know if
you have any questions.

Dave,
Thanks for your email. I can provide the vicinity and can just do so when you turn in the application if you'd like. Or, I can
send it to you. Let me know. I cannot, however, provide a dimensioned site plan. That is something that you will need to
provide. It can be hand drawn, if you want to do it that way, or if you have floor plans for the house then that would
work as well. The dimensioned site plan should show the rooms and the square footage of each, the yard, any fences
you have, the garage, the driveway and the location of the street. Essentially it is a floor plan of your house and an
overall site plan of your property.
You are correct, you need to wait 5 days to turn in your application after you have completed your neighborhood
meeting.
