CUP-04-005 Seal Co. P&Z Commission Hearing Date: April 1, 2004 Recommendation: Denial Summary of Public Hearing: The applicant, Paula Devaney from Seal Co., testified in favor of the application. Two neighbors testified in opposition to the proposed CUP. The primary concern of the neighbors was the incompatibility ofthe proposed commercial use with the existing residential uses. Case No. CUP-04-005 RECOMMENDATION OF DENIAL TO CITY COUNCIL Seal Co., Applicant The property is located at 230 W. Pine Street, Meridian, Idaho. 2. The owners of record of the subject property are Merlyn and Brandon Schmeckpeper. Applicant is Seal Co. 4. The subject property is currently zoned R-4, the applicant is requesting a rezone to O-T. The zoning district of O-T is defined within the City of Meridian Zoning and Development Ordinance, Section 11-7-2. The proposed application requests a conditional use permit for an accounting office and dispatch center for Seal Co.. The O-T zoning designation within the City of Meridian Zoning and Development Ordinance requires a conditional use permit be obtained for most uses including those requested by the Applicant. (Meridian City Zoning and Development Ordinance, Section 11-8-1). 6. The Meridian Planning and Zoning Commission recognizes that the proposed application is in compliance with the Meridian Comprehensive Plan. 7. The use proposed within the subject application will in fact, constitute a conditional RECOMMENDATION TO CITY COUNCIL -1 CONDITIONAL USE PERMIT CUP-04-005 use as determined by City Policy.
