In response to your request for zoning verification for the property located at 307 to 407 E.
Fairview Avenue, please note the following:
• This property is located within the corporate boundaries of the City of Meridian and
currently has a mix of R-8 (medium density residential) and C -G (general retail and
service commercial) zoning.
• A map is enclosed to show the abutting zoning designations for the address listed above.
• The site was not approved as a Planned Unit Development.
• The site is in a floodplain overlay district. For more information on the impact of this
district to the subject property, contact our Surface Water Administrator at 208-898-5500
ext. 1383.
• The site has a nonconforming use at 307 E. Fairview. That portion of the site is zone R-8;
however, it has a commercial use which was deemed nonconforming with CZC-09-024.
In addition, the Elm Grove Trailer Court is a nonconforming use in the R-8 and C -G
zones. UDC 11-1B-4 states nonconforming uses may continue as long as the use remains
lawful and is not expanded or extended. A nonconforming use may be extended to
occupy additional land area only through the approval of a conditional use permit.
Furthermore, no existing structure containing a nonconforming use may be enlarged,
extended, constructed, reconstructed, moved or structurally altered except through the
approval of a conditional use permit or the use of the structure is changed to a
conforming use. In the event the nonconforming use is damaged more than 50% of its
current assessed taxable value by fire, flood, explosion, wind, earthquake, war, riot,
calamity, or other catastrophic event, it shall comply with the Meridian Unified
Development Code upon reconstruction.

Per UDC 11-313-2, additions to the existing structures or developed area that are greater
than 25% will require landscape improvements to the site.
• Documents regarding the subject property are available through a records request at the
Meridian City Clerk's Office.
Staff s failure to cite specific provisions of the Unified Development Code, or existing
conditions of approval associated with the subject property, does not relieve the Applicant of
responsibility for compliance.
