Re: Palmer Sewer Easement Vacation
Request for Vacation of Sewer Easements on Lots 13 & 14 of Taylor Subdivision, by
Larry & Becky Palmer (File No. YAC -04-001).
We have reviewed this submittal and quer the following comments, as conditions of the Applicant
These conditions shall be considered infull, unless expressly modified or deleted by motion of the
Meridian City Council:
The Applicants, Lary and Becky Palmer, request the City's consent to vacate the existing sewer
easements that cross through Lots 13 and 14 of Taylor Subdivision. The easement was created in
1955 per the Right of Way Easement submitted with the application. The easement is no longer
needed, as it only contains service lines for the existing lots. The existing sewer lines do not continue
through to serve any adjoining lots. The applicant desires to redevelop the property with new
structure(s) on top of the current easement Iocation. Sewer service lines will be connected to the
proposed project in new locations and will not require the existing easement. City Ordinance 12-10-2
requires that "any property owner desiring to vacate an existing... easement shall complete and file an
application [for vacation]."
Staff has verified that there are no other users that tie into the existing sewer main. At one time, the
sewer line continued to the south for the parcel currently occupied by Napa Auto Parts. However,
when the lot was developed by Napa, they abandoned their original sewer connection and tied a new
service line to the sewer main in Meridian Road. Meridian Public Works is in agreement that the old
existing sewer main and associated easements that cross Lots 13 and 14 of Taylor Subdivision are no
longer needed and can be abandoned and vacated. The property will still have access to sewer in the
mains located in Meridian Road. Staff recommends approval of the proposed vacation.

The owners of record of the lots on which the subject easement lies are LarryN. and Becky 7. Palmer.
Mr. Palmer has submitted a notarized consent for proposed vacations.
SPECIAL CONSIDERATION
Process: The Subdivision and Development Ordinance (Title 12), Chapter 10, requires the
Planning & Zoning Commission to review and make a recommendation on Vacation
applications. A public hearing is then required before the City Council.
CONDITION OF APPROVAL
Prior to issuance of a Certificate of Zoning Compliance on the subject properties (listed in the
application form), the Applicant shall submit evidence that the requested vacation has been
approved by all required agencies and authorities.
Staff recommends approval of application VAC -04-001.

Nampa & Meridian Irrigation District has no comment on the above referenced
application for sewer easement. However, the District's Rutledge Lateral courses on the
north boundary of this parcel of ground. The easement for the Rutledge Lateral is
twenty-five (25) feet left and twenty (20) feet right from center looking downstream.
This easement must be protected and any encroachment without a signed License
Agreement is unacceptable.
