Dear Mr.Nesmith:
This letter is to confirm that the Director approved the application you submitted for a time extension on
the Modified Conditional Use Permit for the subject property.
In accord with UDC 11-5B-6F, in order for the Conditional Use Permit to remain valid,the Applicant
shall commence the use as permitted in accord with the conditions of approval, satisfy the requirements
set forth in the conditions of approval, and acquire building permits and commence construction of
permanent footings or structures on or in the ground, or submit an application for a time extension on or
before April 2, 2017.
The Applicant,Director, ora Party of Record may request City Council review of a decision of the
Director. All requests for review shall be filed in writing with the Planning Division of the Community
Development Department on or before April 28, 2015,within fifteen(15)days after the written decision
is issued, and contain the information listed in UDC 11-5A-6B.
If City Council review of the decision is not requested,the action of the Director represents a final
decision on a land use application.You have the right to request a regulatory taking analysis under Idaho
Code 67-8003.

SUBJECT: Meridian Automotive — Conditional Use Permit, Minor Modification Time Extension
(File#TED-15-001)
I. APPLICATION SUMMARY
The applicant, John Nesmith, has requested approval of a two (2) year time extension to commence
the building expansion approved with the modified conditional use permit (MCU-13-001). The
primary use of the expansion is to store materials related to the vehicle repair facility. NOTE: The
building expansion will expand the non-conforming use on the site.
The modified conditional use permit for the expansion was approved by the Director on April 2,
2013.Per the conditions of approval,the modified conditional use permit would otherwise expire on
April 2,2015.
The applicant has been unable to meet the time requirements specified in Unified Development Code
(UDC) 11-5B-6F for conditional use permits. The applicant states the expansion has not yet
commenced due to the original contractor selling his business to a bathroom and kitchen remodeler
that is not qualified to complete the Meridian Automotive expansion. The applicant has not, until
now,been able to find a suitable replacement.
The subject property is located at 505 N Main Street.
II. STAFF RECOMMENDATION
Staff recommends approval of a two(2)year time extension for the conditional use permit,as
requested by the applicant,to expire on April 2,2017,with the conditions listed in Exhibit B.
III.STAFF ANALYSIS
The City of Meridian's Unified Development Code(UDC 11-5B-6F3)authorizes the Director to
grant a single extension of time not to exceed one two(2)year period to commence the use approved
with the modified conditional use permit as specified in UDC 11-5B-6F.1,provided that none of the
conditions listed in UDC 11-5B-6F.4 exist.Further,the Director may require compliance with the
current provisions of the UDC as a condition for granting a time extension(UDC 11-5B-6F3).No

The applicant has met the necessary deadline by filing a written request before the modified
conditional use permit expires.Additional time extensions up to two years may be granted if
approved by the Meridian Planning and Zoning Commission.

Exhibit B—Conditions of Approval
1. The applicant shall meet all applicable terms of the previously approved Meridian Automotive
conditional use permits (CUP-02-004; MCU-13-001), certificate of zoning compliance (CZC-04-
074)and other applications approved for this development.
2. The applicant's request to construct a new building addition, not to exceed 715 square feet is
approved, subject to certificate of zoning compliance (CZC) and design review (DES) approval
from the Planning Division prior to obtaining building permits.
