landscape plan by Capitol Landscape:

Terms and Conditions:
PAYMENT AND BILLING
Payment for this contract shall be as follows: a deposit of 50% upon acceptance of this contract. The remaining
balance will be due upon completion of project. A late fee of 3% will be assessed to account each week after invoice
has been past due for 45 days. Capitol Landscape, Inc. does not accept credit cards for any services rendered. All costs
include any applicable sales tax.
WARRANTY
Pending payment in full for this contract, the following warranties apply:
Capitol Landscape, Inc. warranties all work for quality and craftsmanship for the life of the project. All materials will
be warrantied per manufacturers' warranties. All plant material will be warradied for a period of one year from the
time of installation under the following conditions: Capitol Landscape, Inc. must install the plant material; Capitol
Landscape, Inc. must approve of location and exposure of plant material; Capitol Landscape, Inc. must supply or
approve of supplier of plant material; Capitol Landscape, Inc. must install or approve the irrigation conditions at the
site ofthe plant material.
Warranties do not include conditions beyond our control such as neglect, lack of required maintenance, vandalism, and
acts of God. All warranties are null and void if payment is not received in full.
LIEN RIGHTS
Upon payment of invoice in full, Capitol Landscape, Inc. will waive all lien tights to project owner and will provide a
written lien release upon request

Our proposal for this project is attached. We acknowledge no addenda. Our proposal is based on plans
stamped 5/23/2014, pending agency approval notes.
We include only the work as described on the attached proposal. No work can be removed from the
proposal without prior notification and approval. Proposal is based upon a mutually agreeable
construction schedule between MCDI and Owner.
Some comments / questions are
I Should sewer MH #7 have a short stub to North for future connection?
• Notes for 4 fire hydrants, 3 drawn on the plan, please clarify. 4 were bid.
• Blow off per W13 is assumed to be required at end of water and is included
• Should the Pirr drain be located on the NW (low) corner and the Air/Vac be located on the SE
(high) corner?
Our general exclusions also apply:
• No bond is included. Add 2% if bonds are required
• No permits or permit fees have been included.
• Survey and staking are to be supplied by others.
• Compaction testing is to be supplied by others.
• No rock excavation has been included.
• No hazardous material removal is included.
• Excavated material will be wasted on site. No offsite disposal of excavated material has been
included. Cuts /Fills may or may not allow the site to balance — import / export of material is
extra, or allow adjustment to final lot grades to allow site to balance.
• SWPPP and ESC measures are not included. We will comply with measures set forth by Owner
on the project.

McMaster Construction shall he paid for actual quantities installed. Payment is due upon progress billings each 30 days. Retainage held shall be a maximum of 5% The retainage will be
payable upon final acceptance by the governing authority. The amount due shall bear interest at the highest rate allowed bylaw from date of billing.
All work to be completed in aworkmanlike manner according to the specifications and standard practices. Any alteration or deviation from above specifications involving extra costs will be
executed only upon written orders, and will become an extra charge over and above the estimate. All agreements contingent upon strikes, accidents, or delays beyond McMaster
Constructions control. McMaster Construction's workers are fully covered by Workers Compensation surance� McMaster Construction may withdraw this proposal if not accepted
within 15 days from the date of proposal. In the event of litigation, the prey ingvadv shall bee ledt reasonable attorney's fees.
