Jeff asked me to send that to you after the hearing to explain what happened. I spoke with Paul this morning and I told him I would go ahead and prepare the findings for approval on the same night rather than having them on the next agenda but what I didn't think about is that there is a development agreement (DA) associated with this project so it really wouldn't save any time to do that since the DA needs to be signed and approved by Council before the annexation receives final approval. I've asked the City Attorney's office to prepare the DA ahead of time in order to speed up the process. We can get the DA & findings back on the Council agenda for approval on March 24th if you/Paul can make the following things happen: • Come into the Planning division first thing Wednesday (the 18th) morning after the Council hearing and pay the DA fee of $303.00 • You will receive a copy of the DA for the applicant to review and sign and then return to the City Clerk. • If you can return the signed DA prior to 3:00 pm on Thursday, March 19th, we can place it on the March 24th agenda • Once Council approves the DA and the Findings, the annexation & conditional use permit process is complete. Then, you need to submit a Certificate of Zoning Compliance & Design Review application to Planning for review & approval at staff level [I would suggest you start preparing this now (if you haven't already) although I can't accept it until after the 17`"] After approval of the CZC & design review applications, you can submit a building permit application. I will do whatever I can to expedite the remainder of this process for you. MANY apologies for the miscommunication and delays on this project. Hopefully this helps. I was in California on a business trip Jan. 15 -20th and unfortunately the outlook program on my laptop was not allowing transfer or receipt of emails on my trip. At that time Jeff Hatch was still handling the project in my absence and did not make me aware of the re -posting requirement. I spoke to Paul this morning who said he plans on attending the next City Council meeting on March 3rto make sure a church representative is present and plans to re -post the site the next day to insure proper posting is taken care of prior to the City Council meeting the evening of March 17th. The City Clerk received a call from a neighbor yesterday afternoon inquiring about when the Sulamita Church project would be heard by the Commission; his confusion stemmed from the public hearing notice sign on the site being covered by a black plastic bag. Per the City's noticing requirements, the sign has to be posted and visible on the site up until the hearing date. Paul stated that he covered the sign 3 days prior to the hearing because he thought that's what City ordinance required; the ordinance actually requires the sign to be removed from the site 3 days after the final hearing, which in this case would be after the City Council meeting. Because the site wasn't posted with a public hearing notice sign as required by UDC 11-5A-5, the City Attorney deemed the project could not legally be heard by the Commission; therefore, the Commission continued the project to the February 5th meeting to ensure all possible affected and interested parties are legally notified. I clarified the posting requirements with Paul and Jeff after the hearing and Paul was very gracious and didn't have an issue with the continuance. I also advised Jeff that the sign should be updated with the February 5th hearing date as soon as possible to avoid any further confusion on this matter and to forward updated pictures of the sign & affidavit of posting to me. This may fall to you now since Jeff no longer works for Architecture Northwest. Also, for clarification, the project was originally continued from the December 18th to the January 15th meeting at the request of staff due to a noticing error on the part of the City - the legal notice sent by the City to adjacent property owners & the newspaper showed the property address incorrectly. As the applicant's representative, I wanted to provide a full explanation to you regarding the delays in the hearing process for this application. Please let me know if you'd like to discuss further.
