Meridian City Council December 2, 2014 A meeting of the Meridian City Council was called to order at 6:03 p.m., Tuesday, December 2, 2014, by Mayor Tammy de Weerd. Members Present: Mayor Tammy de Weerd, Keith Bird, Charlie Rountree, David Zaremba, Joe Borton, Genesis Milam and Luke Cavener. I'd like to welcome you to Meridian City Council's Tuesday night meeting. For the record it is Tuesday, December 2nd. So, you know how many shopping days are left before Christmas. It is a few minutes after 6:00. We will start tonight's meeting with roll call attendance, Madam Clerk. Item 2: Pledge of Allegiance De Weerd: Item No. 2 is the Pledge of Allegiance. If you will all rise and join us in the pledge to our flag. (Pledge of Allegiance recited.) Item 3: Community Invocation by Jim Lester with Valley Shepherd De Weerd: Okay. So, Item No. 3 is the community invocation by Jim Lester. He is with Valley Shepherd Church of the Nazarene. If you will all join us in the community invocation or take this as an opportunity for a moment of reflection. Thank you for joining us tonight. Lester: My privilege. Our Father, we are so amazed by your goodness to us. Having come off of the wonderful Thanksgiving season we are reminded how true scripture is that all good and perfect gifts come down from the Father above. We recognize you are the giver of all good things that come into our lives and for all the benefits and blessings we give you praise and we also know that you promised to give us wisdom and in the word it tells us if any man lacks wisdom let him ask of God and we are asking tonight for this meeting, for the wisdom of the Lord to be upon each of these members that make the Meridian City Council December 2, 2014 Page 2 of 16 decisions -- as they hear the various business that will be coming before them and the opportunity to govern our city. We ask, Father, that you would give them the wisdom and direction they need. Item 5: Community Items/Presentations Meridian City Council December 2, 2014 Page 4 of 16 A. Police Department: President of Meridian Lock and Key to be Presented a Community Service Award for Rescuing Children in Locked Vehicles Free of Charge De Weerd: Under 5-A, Community Presentations, I will turn this over to Sergeant Gonzales. Can I come join you? Gonzales: Please, Mayor. Thank you. Madam Mayor and Council, I'd like to make a presentation. If Randy with Meridian Lock and Key could join us. As they approach, let me just read. We want to present them with a community service award. The Meridian Police Department would like to recognize Meridian Lock and Key for their commitment and service to our community. When called upon for help Meridian Lock and Key immediately will send a locksmith technician to help rescue people in need. The company has a policy to help without charging a fee when children are locked in cars, a lock out situation involving handicapped people or -- and/or welfare checks. The services of Meridian Lock and Key are most used when children are accidentally locked in vehicles. Their quick response has helped us, the Meridian Police Department, not have to damage property while still being able to rescue children or other individuals in locked situations. When time is of the essence and when dealing with safety issues, the Meridian Police Department is grateful to be able to call upon Meridian Lock and Key for help in accessing people in need. So, thank you Meridian Lock and Key for what you do for us in helping us contribute to our community. B. Amended onto the agenda: Mayor's Youth Advisory Council (MYAC) Update De Weerd: Thank you for being here this evening. We are appreciate you being here. Okay. Item No. 5-B is the Mayor's Youth Advisory Council. Tonight we will hear from Cady Snell, who will give us an overview of what the youth have been up to. This is the first time that they are in front of you this fall, so they have been busy. Hi, Cady. Snell: Hi. Madam Mayor and Members of the Council, I'm Cady Snell. I am the chair person for the Mayor's Youth Advisory Council. This year we have a roster of approximately 175 youth on our council. During meetings we have about 120 active members. So, the first thing that we'd like to talk about is the Treasure Valley Youth Safety Summit. We have 200 youth come annually to Wahooz and we focus on the dangers of distracted driving, underage drinking, and drug use, bullying and self defense led by Chief Basterrechea. That's a hard name to say. By Tracy. And so we -- we learned a lot of things -- just safety tactics through this event and it's a fun way to get our youth active in the community. So, here are a few pictures. Mayor Tammy is there in the go-cart -- De Weerd: Oh, great. Snell: -- and she's also leading us in a dance. Meridian City Council December 2, 2014 Page 5 of 16 De Weerd: I have such moves, you know. Snell: Next we have the Public Safety Day. We partnered with the Meridian police and fire on their crime -- sorry -- their Crime and Fire Prevention Day. We have a few pictures for this as well. So, the students got to help direct children or adults on trikes with the impaired vision goggles. Next we had the KTVB Just Drive anti-texting campaign. KTVB, Idaho Power, and the Idaho Transportation Department chose our group to be the featured teens in a public safety announcement called Just Drive and the MYAC members got to drive police cruisers in a closed track to display how hard it is to multi -task while driving. So, here is a picture for that as well. De Weerd: Cady, is that like the third year, second year, we have done that? Sergeant Gonzales, do you recall? Bird: The second I think. Gonzales: I believe it's the second, Mayor. De Weerd: Okay. Snell: Next we have the Idaho Legislative Candidate Forum. We held that and we were able to have -- we were able to act as timers for the forum, as well as we had two members sitting on a questioning panel. We formulated questions and we also took questions from the audience and that was through the Meridian Chamber of Commerce. Next we have the Trunker Treat event, which is our second annual. We had 80 businesses decorate their trunks in a Halloween fashion. Family friendly, of course. We -- we filled nine bins of food. Last year we only had three, so that was quite the improvement for us. We had 7,000 community attendees and on our Facebook page we had a city record for the album of the Trunker Treat. We had 26,000 views, which is a city record. So, that's quite awesome. Next we have the Meridian fun bus outreach, which we partnered with the Valley Regional Transit in order to promote their business. We had 30 MYAC members ride this bus on a Saturday to get their friends to know about this transportation mode. We had them using Facebook, Twitter, Instagram, all other forms of social media to get the news out there and in reward for their service we provided them with free bowling at Pinz. Here is a few pictures from Patrick Dilley's Instagram. Go ahead. Next we have the MYAC mixer, which we just did last Monday. That was just an opportunity for the MYAC members to get to know each other, as our council is very large this year. We are bursting at the seams and we wanted to make sure everybody had the opportunity to meet one another in a less formal setting. So, here is a few pictures from that. We have Mayor Tammy there playing Foosball with one of our MYAC members. Our large group that went. Some dancing. We had lots of fun on that. And we just recently received an award -- the Association -- Association of Fundraising Professionals 2014 Outstanding Youth In Philanthropy award. So, we had two MYAC members, Hanna Chambers and Daniel Hightop. We received this award because of our outstanding service to our community and also the money that we raise to help our local organizations, such as Buckle Up For Bobby. We also helped the American Heart Association. So, Meridian City Council December 2, 2014 Page 6 of 16 there is a few -- there is one picture, I believe, actually, of them receiving the award. And finally we are going to talk about the National League of Cities. So, this was a conference that the executive council went to last week. So, six of our ten members were able to attend. Celebrating its 90th year we were honored to be there with Mayor Tammy and Mr. Borton. We had the opportunity to work with elected officials throughout the nation. My favorite part was actually being able to work with the young elected officials, as that opened my eyes to the idea that you don't have to be in politics and you don't have to be of a certain age to make a difference in your community. Also we were able to collaborate with other youth councils in order to broaden our world view of many things and our leadership skills were refined and we came home with many tools and ideas that we plan on using in the coming year. I will now stand for questions if there are any. De Weerd: Council, do you have any questions? Rountree: How did you have time to study? Snell: It's a juggling game, but I definitely managed. Rountree: Good job. Bird: Good job. Cavener: Madam Mayor? De Weerd: Yes, Mr. Cavener. Cavener: Cady, when you interact with these other youth councils where does the Meridian youth council rank? Are we the leaders? Are we -- were you interacting with other larger councils? I mean where does -- where does the Meridian youth council sit compared to the other ones? Snell: So, in regards to size ours was definitely the biggest of the ones that were in attendance and also in regards to our activeness in our community we definitely had more that we did. We have more -- different focuses than the other councils did. One other had a suicide focus and so they all had about one thing that they were looking and we have reached a larger scale of people. Cavener: Good. De Weerd: Yes. And I think also what they found is our -- our youth council is very inclusive, so it includes all kids. It's not by nomination or application or anything like that and -- and I think in a number of things that Ken and I found that we -- we do exceed the activities of other youth councils and I think some of that is because of our numbers, that they are able to distribute the amount of work and involvement over a larger number of students, so that's helpful. But I will say that our -- our youth that attended represented our city well and they had a lot of takeaways and one of those is the collaboration they Meridian City Council December 2, 2014 Page 7 of 16 had with Caldwell and Middleton and now they have come together and said it would be helpful to bring the youth together on a more regular basis, so that they can collaborate and share what they are doing in each of their communities. We had Eagle and Middleton that are going to come and join us for our Mad City Money activity next week and so some of this is already paying back in -- in those partnerships that have been forged. I will also say that part of this we had under the Trunker Treat and the Fun Bus a young man who videotaped and put together the two awesome videos that are available on YouTube and if you haven't gone on -- I think a link was sent to you and watch that. It just showed the energy and excitement that these young leaders are stimulating and really modeling in our community and I will also say on Cady's behalf -- Cady is part of a national youth organization board and through that board and the relationship she formed there, she brought in a 2,000 dollar sponsorship that allowed these youth leaders to go to the National League of Cities and was able to introduce our team to the -- the sponsor one of the evenings and just -- it was, again, another show of the leadership that we have on our youth council and just want to congratulate Cady for the true leader that she showed at that, as well as in -- on other occasions. So, we appreciate you, Cady. Snell: Thank you De Weerd: Anything further from Council? Thank you for joining us and sharing the activities of the youth council. Snell: Thank you. De Weerd: And I will reiterate what she said about the trunker treat and the 26,000 hits. That community activity not only broke the social media record that we had, but it created such amazing energy and excitement. It paid forward time and time again. So, just -- just to recognize that's -- that's a community event. This was the second annual that it's already a much talked about event and I think that our youth council and our advisors have a lot to be proud of in bringing that to our community. So, thank you. And thank you, Ken, and certainly OG, Officer Gomez, and Patrick and the Parks Department, they are just awesome with these kids and we couldn't do it without them. So, many thanks. Item 6: Items Moved From Consent Agenda D. Public Comment: Community Development Block Grant (CDBG) PY2013 Consolidated Annual Performance Evaluation Report (CAPER) De Weerd: Okay. Well, we will move to Item No. 6. We did have an item moved from the Consent Agenda. Item D under the Community Development Block Grant. I will turn this over to Bruce. Chatterton: Mayor and Council Members, this is -- this will be very quick. This is just really a quick note to let you know that we have started the public comment period for our CDBG program CAPER. CAPER is, as I'm sure you remember -- I have to look at it Meridian City Council December 2, 2014 Page 8 of 16 myself. It stands for Consolidated Annual Performance and Evaluation Report. The CAPER is simply a fancy word for documenting a look back at our program year and asking the question did we do what we set out to do. We have advertised the public comment period in the Statesman and the ValleyTimes. It started actually yesterday, December 1 st. At your December 16th meeting we will formally close the public comment period, take any comments that we have received from Mayor and Council or from the public in general, and after addressing those comments we will be able to submit the CAPER to HUD. So, simply a note for you all. It probably shouldn't have been on the Consent Agenda anyway. It's hard to do a public comment item under consent. Public Hearing: Proposed Code Adoptions and Local Amendments - 2012 International Building Code, 2012 International Residential Code, 2012 International Energy Conservation Code, 2014 National Electrical Code, 2012 Edition Of The International Mechanical Code, 2012 International Fuel Gas Code De Weerd: Okay. 7-A is also under our Community Development, Building Services Division, and, Brent, I assume you're taking this one. Bjornson: I am. Good evening, Madam Mayor and Members of the Council. As you're aware, the building code adoption is a collaborative effort to work on and bring in the building codes. Local jurisdictions are required to adopt the codes by January 1st of the year following the state adoption, which is what our plan is right now. De Weerd: Brent? Bjornson: Yes. Meridian City Council December 2, 2014 Page 9 of 16 De Weerd: I'm just going to introduce you -- or interrupt you and say I will open Item 7-B, our public hearings, so that your comments are included in that. Bjornson: Following the Idaho statute we notified the groups as required. October 27th we notified the general public through the ValleyTimes of this public hearing and our adoption. October 31st per Idaho statute we notified about 13 external groups, as well as eight additional that we added. We provided draft copies of the adoption to those groups and, then, on November 5th we attended the Council meeting and presented our draft to you at that time and the timeline for adoption. November 12th I presented the adoption to the Building Contractors Association. They also received a mailer previously. We had no negative responses to Community Development or to the city clerk's office, so it was well received I would say. I would like to point out there are a couple of small changes that I have added in. Worked with Emily on that. On page four -- I don't -- do you have copies in front of you by chance? Bird: Yes, we do. Bjornson: Yeah. On the draft ordinance on page four, letter O, very simple. These corrections are based on a state -- state version that was updated, so it's just following the state. On letter O on page four it says drinking fountains are required, but drinking fountains are not required for an occupant load of 30 or fewer. So, we added the word not. And, then, on page five, letter C, the exception says owner occupied lodging houses with three or fewer guest rooms, that number was modified to five. And, again, that was based on a state update on their language and so we just followed that as a late add. The timeline remaining, December 9th is the second reading, December 16th is the third reading and adoption and, then, on January 1 st would be implementation. That's really all I have and happy to stand for any questions at this time. De Weerd: Thank you. And in particular I'd like you to -- I'd like to thank you for the page four, letter O, adding not. I was told today that the key was to tell you that I am not here to ask for additional funding, that I am here to ask you for spending authority for a grant that we received from Idaho Power. Just to give you a little background about this. We kind of jumped on board with the Department of Commerce and BVEP. Two of the biggest initiatives throughout the valley right now is for business recruitment and, then, of course, talent attraction. The idea behind this was to get the companies that are located here to talk about what it's like to be here. So, we applied for this Idaho Power grant and we received a 5,000 dollar grant and so what I'm asking is for the authority to spend that. And what's really nice about this video is that even though it's for recruitment we actually partnered with Power Engineers, United Heritage, so a lot of their engineers and IT professionals are the ones that are being highlighted. Sergeant Gonzales. Gonzales: Madam Mayor and Council, I'm here to request spending authority for 22,000 dollars in reference to the instruction of the Alive At 25 program. We have been involved with Alive At 25 since December of 2011 and I think it's reaped its benefits in Meridian and as a result we want to continue that program. This is grand funding provided to us as reimbursement for salaries for officers to teaching the Alive At 25 program. De Weerd: And, Council, I think that Sergeant Gonzales and his team need to be recognized. Bird: Amen. De Weerd: I think that the Meridian Police Department is the example in this state for the Alive At 25 and they beat this drum, they walk the talk, and it's why year after year we continue to get this grant and continue to train record number of individuals in this program. So, hats off to you, Sergeant Gonzales, and to your team. If you will, please, pass that onto your instructors. They make us very proud. Gonzales: Thank you, Mayor. I will pass that on. Police Department: Budget Amendment for Award of FY2015 Traffic Enforcement Grant from the Idaho Transportation Department and Office of Highway Safety for the Not -to -Exceed Amount of $51,000.00 De Weerd: Item 8-C is also under our Police Department. Gonzales: Thank you, Madam Mayor. This is also a grant requesting spending authority for the amount of 51,000 dollars. This is for overtime and incentive equipment funding through the Office of Highway Safety out of the Idaho Transportation Department. These are working emphasis areas, such as impaired driving, seat belt enforcement, aggressive driving enforcement. These are opportunities for us to earn incentive monies for equipment and, then, also to be able to have officers work overtime when necessary on these projects as well. Arts Commission: Budget Amendment for Art to be Installed on the Barrier Rail of the Meridian Road Overpass of 1-84 for the Not -to -Exceed Amount of $55,400.00 Meridian City Council December 2, 2014 Page 14 of 16 De Weerd: Item 8-D is under our Arts Commission. We will turn this over to Robert. You have heard the presentation for the most part last week and as was stated then, Robert would be back in front of you with this item. Bird: And I'm glad he is. Simison: Madam Mayor, Members of the Council. As the Mayor just said, you heard the presentation last week and this is the result of that presentation for a budget amendment of 55,400 so we can move forward on the art project and I imagine we will be coming back at some point in time with the final version of what it will look like in terms of color and metals, but we do anticipate going forward with the stainless steel, painted version at this point in time. Just what it will look like will be finalized as we work with the people doing the work. So, with that I would stand for any questions. De Weerd: Thank you. Bird: Madam Mayor? De Weerd: Mr. Bird. Bird: I just want to clarify one thing. Brian was too nice not to tell me that I was out of line with the -- with the material they have to -- the state requires the stainless steel and so apologize to Brian. I personally did and -- anyway, I told him not to be so scared next time to tell me when -- tell me where to go. De Weerd: He still won't do that. Bird: No. I hope he does. But I also got a question. Last -- where did the 400 dollars come in at? It was 55,000 last week. Now -- is every week going to grow at 400, Robert? Simison: That was just the -- the straight amount that -- and if I only said 55,000 -- I thought 55,400 was on the slide. So, if it wasn't I apologize. De Weerd: That was the sale tax. Milam: I wish I could only pay 400 dollars sales tax on 55,000. Bird: We don't pay sales tax. De Weerd: Any legitimate questions? Bird: No. I just had to clarify and say one thing for Brian. Bruce, would you -- would you thank Caleb and Brian for the bricks that they got for us from the McFadden building. It's highly appreciated. I certainly appreciate what they did. Would you make sure they get thanked. I wanted to publicly thank them, but neither one of them is here. Chatterton: Madam Mayor and Council Member Bird, yes, absolutely I will. And I also as you may know, at the Mayor's request Brian and our Parks Department were instrumental in getting -- in saving the market sign as well. Bird: We appreciate that. Chatterton: So, kind of a team effort there. Bird: Thank you very much, Bruce. De Weerd: It was an amazing team effort. You know, with -- with Brian and Roger and the crew that -- we were very fortunate they were out doing the banners and that sort of thing. So, very fortuitous. It was a sad day in the City of Meridian to see the McFadden building go down and I know it was a dangerous nuisance property. It was very dangerous. And the city really did go through as many steps as we could to figure out how to save it. The owners just saw more value than anyone else saw in the property and so it was very unfortunate. But I will say I appreciate all of the effort from our legal team, to Community Development, to the MDC, to do what we could to stir up interest in trying to Meridian City Council December 2, 2014 Page 16 of 16 save that building. Actually saved certain elements to it. It was a little bit shocking to us that there was not any attempt to preserve anything from that building. So, we appreciate the efforts. Both Bruce and Steve, if you can convey that to your staffs. And, Steve, since we are not on agenda topics right now. Heart felt thanks to your team for creating just a beautiful plaza, all the efforts with decorating the Christmas tree and just -- it's an amazing effect and John was out there trying to figure out how to get the electricity to work for the plaza lights, but it's just -- it's incredibly warming to walk through there and it just gives you that great sense of Christmas. Siddoway: Thank you. I just want to mention that I have an all staff meeting in the morning with all the maintenance staff that did the work, so I will be sure to pass that onto those that deserve credit.
