Under the
MASTER AGREEMENT FOR PROFESSIONAL SERVICES
BETWEEN
CITY OF MERIDIAN (OWNER) AND JUB ENGINEERS, INC (ENGINEER)
This Task Order is made this f34 -K day of September, 2011 and entered into by and between
the City of Meridian, a municipal corporation organized under the laws of the State of Idaho,
hereinafter referred to as "City", and accepted by JUB ENGINEERS INC,.hereinafter referred to as
"Engineer" pursuant to the mutual promises, covenant and conditions contained in the Master
Agreement between the above mentioned parties dated January 1, 2007. This task order is for as -
needed consulting services and may be terminated by City at any time. The Project Name for this
Task Order 10046d is as follows:
WWTP GRIT SYSTEM IMPROVEMENT PROJECT -
CONSTRUCTION OBSERVATION SERVICES
SCOPE OF SERVICES
SECTION 1 - PROJECT UNDERSTANDING
PURPOSE
This scope of work is to provide construction observation services, for the construction of Grit System
improvements at the Meridian WWTP. This is a capital project administered by the City of Meridian.
PROJECT DESCRIPTION
This project will consist of grit system modifications to existing grit chambers #1 and #2, piping, demolition and
removal of existing equipment and piping. .
The project general contractor will be required to obtain building permits through the City and schedule related
inspections. These inspections shall be conducted by the City's Building Department for general compliance to
building codes.
PROJECT STATUS
The City of Meridian is scheduled to retain a contractor in July with anticipated Notice to Proceed in mid-July,
2011. This project is estimated to last up to 90 calendar days. J -U -B field personnel support for construction
observation services is expected (based on the contractor's start date) for a period of up to 90 calendar days.
SECTION 2 — CITY RESPONSIBILITIES
2.1 The Construction contractor retained by the City of Meridian will supply a detailed construction schedule at or
prior to the pre -construction conference from which a staffing schedule can be modified to meet the
observation requirements of the construction activities throughout the project.
2.2 The City of Meridian will hold construction progress meetings with the contractor. At these meetings, the
contractor will provide project schedule updates (monthly) and short-term look -ahead schedules detailing the
activities planned for the following three weeks.

2.3 The City of Meridian will provide or designate a representative to review contractor submittals and provide
approved shop drawings to the J -U -B observer as necessary to support the work. The City Project
Engineer, Roxanne Holland, shall serve as a liaison with the Engineer of Record, SPF Water Engineering,
and J -U -B for communications and direction.
2.4 Provide such legal services as CITY OF MERIDIAN may require.
2.5 Attend the pre-bid conference, bid opening, pre -construction conferences, construction progress and other
job-related meetings and Substantial Completion, start-up, and final project close-out meeting.
2.6 Give prompt written notice to J -U -B whenever CITY OF MERIDIAN observes or otherwise becomes aware of
any development that affects the scope or time of performance or furnishing of J -U -B's Services, or any
defect or nonconformance in J -U -B's Services or in the Work of any contractor.
2.7 Render all final decisions related to: 1) changes or modifications to the terms of the construction contract, 2)
acceptability of the Work, and 3) claims or Work stoppages.
2.8 Provide construction staking services for the project.
2.9 Provide direction and coordination with the Engineer(s) of Record.
2.10 Review and comment on any temporary plant operational modifications requested by the Contractor to
complete the project.
SSCTION 3 - SCOPE OF SERVICES TO BE COMPLETED BY J -U -B
J -U -B shall furnish the services described below. J -U -B shall provide construction observations of this project
while coordinating with the City project engineer, Roxanne Holland, Wastewater Treatment staff, contractors and
Engineer. J -U -B shall immediately notify the City project manager, via phone call or face to face communication,
of any observed non-compliant work. J -U -B shall observe the contractor's corrections of observed non-compliant
work brought to compliance and shall communicate the results with City project manager. J -U -B shall
communicate any concerns and issues relating to contract specifications, materials, costs, safety, and timelines
to the City project manager.
It is understood and agreed that J -U -B shall not, during the performance of Services, or as a result of
observations of the Work in progress, supervise, direct, or have control over contractor(s) Work; nor shall J -U -B
have authority over or responsibility for the means, methods, techniques, sequences or procedures of
construction selected by contractor(s), for safety precautions and programs incident to the Work of the
contractor(s) or for any failure of contractor(s) to comply with laws, rules, regulations, ordinances, codes or
orders applicable to contractor(s) furnishing and performing their Work or providing any health and safety
precautions required by any regulatory agencies. Accordingly, J -U -B does not guarantee or warrant the
performance of the construction contracts by contractor(s) nor assume responsibility of contractor(s) failure to
furnish and perform their Work in accordance with the Contract Documents.
The City of Meridian agrees that the general contractor shall be solely responsible for jobsite safety, and
warrants that this intent shall be carried out in the City of Meridian's contract with the general contractor. The
City of Meridian also agrees that the City of Meridian, J -U -B and J -U -B's subconsultants shall be indemnified by
the general contractor per the ISPWC General Conditions.
J -U -B shall not be responsible for the acts or omissions of any contractor or of any of their subcontractors,
suppliers, or any other individual or entity performing or furnishing any of the Work. J -U -B shall not be
responsible for failure of any contractor to perform or furnish the Work in accordance with the Contract
Documents.

3.1 CONSTRUCTION OBSERVATION SERVICES
3.1.1 Observation & Documentation
A. J -U -B will prepare observation reports on City forms recording Contractor hours on the site, weather
conditions, equipment (inactive and active) on the project field orders, or known changed conditions,
site visitors, daily activities, decisions, observations in general, and specific observations in more
detail (as in the case of observing test procedures); and send copies to City project manager. Project
Photos will be included with daily reports when appropriate.
• Attend preconstruction and construction progress meetings as requested
• Project diary documentation of all observations
• SWPP compliance inspections as the Owner's rep. Includes waste site and source
inspections when required.
• Pay request quantity verification
• General site review and progress reporting
• Provide written comments, as requested by the City project manager, for the City project
managers use in the preparation of project punchlist(s) and final walkthrough
documentation
• Provide written comments, as requested by the City project manager, for the City project
managers preparation of Work Change Directives, and Change Orders
B. Observations(Part-time) should cover the following activities:
• Observe demolition and salvage materials
• Observe equipment installation.
• Observe sample and test locations.
• Observe grade and compaction operations (consistent with tested locations)
• Verify reinforcing steel install (layout, tolerances, and ties) prior to concrete placements
• Verify form work prior to concrete placements
• Observe concrete placements; consolidation; batch tickets; finish, slope; cure; and joint
installation
• Observe grout operations
• Observe field welding and confirm special inspections
• Observe and confirm required inspections and testing as noted in contract documents
• Verify the products used are the approved products as related to the above scope of work
• Observe air and process piping installation and testing
C. Project Close-out
• Review contractors as -built drawings for accuracy before City forwards to design
consultant for record drawing production
• Verify inspections and testing reports by others and their results for conformance to
project requirements.
3.1.2 Environmental Inspections
J -U -B will provide the following:
National Pollutant Discharge Elimination System (NPDES) — Storm Water Prevention and
Pollution Plan (SWPPP) inspections will be conducted weekly and within 24 hours of a significant
rain event on the project. Each inspection will be performed to verify compliance with the City of
Meridians Construction Storm Water Management Program and the approved project SWPPP.
The inspection form within the City of Meridians Storm Water Program shall be utilized. Sources

and waste sites; (where applicable) will also be inspected in accordance with the approved ESCP
plan.
3.1.3 Waste Inspection: J -U -B will provide the following:
The Contractor's designated waste sites will be inspected for permit compliance in accordance
with to the contract specifications.
3.1.4 Deliverables: J -U -B will provide the following:
• Field Personnel on site during construction activities.
• Daily Diary Report Forms, and photographs on a weekly basis (electronic format).
• City of Meridian Environmental Inspection Forms.
• Monthly Invoices and monthly progress reports
3.1.5 Equipment: J -U -B will provide the following:
All necessary personnel safety equipment in accordance with standards of the Occupational
Safety and Health Administration (OSHA), Mine Safety and Health Administration (MSHA) ,
Idaho Department of Labor.
J -U -B will provide photographic equipment, safety equipment, and any other items that are
necessary for performing the work.
Vehicles (equipped with at least one amber rotating/strobe warning beacon) and cellular
phones for use only on this project.
3.1.6 Assumptions
• J -U -B's role is to provide augmentation of city staff for construction observation and J -U -B
shall be afforded the same protections as the Engineer under the construction contract
documents.
J -U -B's observation work will be as directed by the City and will be limited in scope and
frequency for the items to be observed. J -U -B is required to coordinate with the City project
engineer before rejecting work or materials that do not meet the project plans and
specifications. The furnishing of such observation Services will not extend J -U -B's
responsibilities or authority beyond the specific limits set forth elsewhere in this Agreement.
LIMITATIONS OF AUTHORITY
JUB shall not:
1. Authorize any deviation from the Contract Documents or substitution of materials or equipment (including
"or -equal" items).
2. Exceed limitations of J -U -B's authority as set forth in the Agreement for Professional Services.
3. Undertake any of the responsibilities of contractor, subcontractors, suppliers, or contractor's
superintendent.
4. Advise on, issue directions relative to, or assume control over any aspect of the means, methods,
techniques, sequences, or procedures of construction or of the Work, unless such advice or directions
are specifically required by the Contract Documents.
5. Advise on, issue directions regarding, or assume control over safety practices, precautions, and
programs in connection with the activities or operations of the City of Meridian or contractor.
6. Participate in specialized field or laboratory tests or inspections conducted by others, except as
specifically authorized.

7. Accept Shop Drawing or Sample submittals from anyone other than the City of Meridian.
8. Authorize the City of Meridian to occupy the Work in whole or in part.
9. Act as the construction contractor's Quality Control manager or superintendent.
10. Inspect or act as the Coating system manufacturer or coating system applicator's representative.
11. Approve the suitability of existing structures to be modified, existing foundation conditions, modifications
to treatment processes, shoring or underpinning plans, or by-pass pumping plans.
12. Provide a geotechnical engineer to observe structure foundation conditions once the foundation area is
exposed, and provide recommendations to the City Project Engineer on any design modifications
necessary.
13. Provide electrical and instrumentation equipment inspections.
14. Provide materials testing.
INDEMNIFICATION
Contractor has agreed to the indemnification requirements of the ISPWC General Conditions as such these
Owner protections will be passed on through to J -U -B.
TIME OF PERFORMANCE
Expected construction duration for the project is 90 calendar days. Technician time is based on part time
observation (13 weeks of coverage at an estimated average of 20 hours per week during the main construction
of 9 weeks and start-up/shut down period of 10 hours per week for 4 weeks).
COMPENSATION
The Not -To -Exceed amount for this Task Order No. 10046d is Twenty-four Thousand Ninety-one dollars and
fifty-seven cents ($24,091.57). The hourly rates for services and direct expenses is per the Master Agreement
and by this reference made a part hereof.

Costs will be billed for actual time services are rendered up to the Not -to -Exceed amount. No compensation will
be paid over the Not -to -Exceed amount without prior written approval by the City in the form of a Change Order.
