The applicant, The Club at Spurwing, LLC is requesting approval to vacate the two (2) 5 -foot wide
public utility, drainage, and irrigation (PUDI) easements located on the common lines between Lots 7
and 8, Block 1 of Spurwing Rim Subdivision.

Staff recommends approval of the subject vacation application.

5. PROCESS FACTS
The subject application is a request to vacate platted easements. Per Meridian City Code Title 11,
Chapter 5, the City Council is the decision making body on this matter. The UDC does not require the
site to be posted with a public hearing notice sign.

6. LAND USE
A. Existing Land Use(s): This property is currently two (2) vacant residential lots, zoned R-8.
B. Character of Surrounding Area and Adjacent Land Use and Zoning: The surrounding area is
developed with single family residences, zoned R-2 and R-8.
C. History of Previous Actions: In 2013, the property received final plat (FP -13-046) approval to
develop the Spurwing Rim Subdivision. The easements proposed for vacation were created with
the recordation of the plat.
Recently, the Director tentatively approved the consolidation of Lots 7 and 8, Block 1 into a
single parcel through a property boundary adjustment (PBA -14-015).
7. AGENCY COMMENTS MEETING
No comments were received by the Planning Division from other City departments for the subject
application.
8. STAFF ANALYSIS
The applicant requests approval to vacate the two (2) 5 -foot wide permanent public utilities, drainage,
and irrigation (PUDI) easements located on the common lot line between Lots 7 and 8, Block 1 of
Spurwing Rim Subdivision. The two lots have been approved to consolidate through a property
boundary adjustment. Approval of the subject vacation application will remove the PUDI easements
and allow the construction of a single home on the consolidated parcel. Further the property boundary
adjustment of the parcel has necessitated the termination of one of the existing sewer services and one
existing water service. Prior to applying for a building permit, the applicant must coordinate with the
Public Works Department on the abandonment process for the unused sewer service, and with United
Water of Idaho on the water service.
All public utilities (Idaho Power, Century Link, Cable One, Intermountain Gas) have given consent to
relinquish the easements. The pressurized irrigation system is a private system, owned and maintained
by the home owner's association therefore; the Settlers Irrigation District has no jurisdiction over the
easement area. Since none of the applicable utility providers object to the proposed vacation, Staff
recommends approval of vacating the easements as proposed in Exhibit A.2.

Spurwing Rim Subdivision
Public utility, pressure irrigation and lot drainage easements per Note 2 of the plat of
Spurwing Rim Subdivision, as filed for record in Book 107 of Plats at Page 14783, records of
Ada County, Idaho, located on Lots 7 and 8 of Block 1 of said subdivision, being strips of land
5.00 feet in width, adjacent to each side of the following described easement line:
BEGINNING at a %2 inch iron pin marking the Northwest corner of Lot 7, Block 1 of said
Spurwing Rim Subdivision, from which a 1/2 inch iron pin marking the southwest comer of said
Lot 7 bears South 00028'32" West a distance of 125.00 feet; thence along the lot boundary
common to said Lots 7 and 8 South 89°31'28" East a distance of 125.78 feet to a 1/2 inch iron
pin marking an angle point on said boundary;
Thence continuing along said comrnon boundary South 50°02'32" East a distance of
67.88 feet to a %2 inch iron pin on the westerly right-of-way of N. Spurwing Rim Place, the
ENDING POINT of said easement line.
