APPLICATION SUMMARY The applicant, Clay, LLC, is requesting approval to vacate two (2) 5 -foot wide public utility, drainage, and irrigation easements on the shared lot line between Lots 1 and 2, Block 1 of Wyndstone Place Subdivision. 2. STAFF RECOMMENDATION Staff recommends approval of the subject vacation application. 3. PROPOSED MOTION Approval After considering all staff, applicant, and public testimony, I move to approve File Number VAC -14- 005, as presented in the staff report for the hearing date on August 26, 2014. APPLICATION AND PROPERTY FACTS A. Site Address/Location: The site is located north of Interstate 84 and west of S. Wells Street in the southeast'/4 of Section 17, Township 3 North, Range 1 East. B. Applicant/Owner(s): Clay, LLC 17010 SW. Weir Road Beaverton, Oregon 97007 C. Applicant's Statement/Justification: Please see applicant's narrative for this information and the application file for the applicable relinquishment approvals. 5. PROCESS FACTS The subject application is a request to vacate platted easements. Per Meridian City Code Title 11, Wyndstone Place — VAC -14-005 - 1 - Chapter 5, the City Council is the decision making body on this matter. The UDC does not require the site to be posted with a public hearing notice sign. A. Newspaper notifications published on: August 4, and 18, 2014 B. Radius notices mailed to properties within 300 feet on: July 31, 2014 6. LAND USE A. Existing Land Use(s): This property is consists of two (2) vacant commercial lots, zoned L -O. B. Character of Surrounding Area and Adjacent Land Use and Zoning: The surrounding area is primarily developed with office buildings and county residences, zoned L -O and RUT. C. History of Previous Actions: In 2005, the property received annexation, preliminary plat, conditional use permit and final plat approval (AZ -05-010, PP -05-012, CUP -05-014 and FP -05- 048) to develop an office park. Recent applications: A certificate of zoning compliance (CZC-14-033) has been approved to construct a new 8,544 square foot dental office. The Director has approved the consolidation of lots into a single parcel through a property boundary adjustment (PBA -14-010). 7. AGENCY COMMENTS MEETING No comments were received by the Planning Division from other City departments for the subject application. 8. STAFF ANALYSIS The applicant requests approval to vacate the two (2) 5 -foot wide permanent public utilities, drainage, and irrigation (PUDI) easements located on the common lot line between Lots 1 and 2, Block 1 of Wyndstone Place Subdivision. The two lots have been approved to consolidate through a property boundary adjustment. The applicant is vacating the easements and consolidating the lots to construct a new 8,544 square foot dental office. (See the approved site plan in Exhibit A.2) The Planning Division has approved a certificate of zoning compliance for the site development however; the building permit cannot be issued until the easements are vacated and record of survey approved with the property boundary adjustment is recorded. All public utilities (Idaho Power, Century Link, Cable One, Intermountain Gas) have given consent to relinquish the easements. NMID submitted a letter stating they have no facilities within the easement area. Staff recommends approval of vacating the easements as proposed in Exhibit A.3. Gm *14- A. Drawings 1.
