Land Use Public Hearing Process: After the Public Hearing is opened the
staff report will be presented by the assigned City planner. Following Staffs
report the applicant has up to 15 minutes to present their application. Each
member of the public may provide testimony up to 3 minutes or if they are
representing a larger group, such as a Homeowners Association, they are
allowed 10 minutes. The applicant is then allowed 10 additional minutes to
respond to the public's comments. No additional public testimony is taken
once the public hearing is closed.
The City Council may move to continue the item for additional information or
vote to approve or deny the item with or without changes as presented. The
Mayor is not a member of the City Council and pursuant to Idaho Code does
not vote on public hearing items, unless to break a tie vote.

1. Request: Annexation and Zoning of 38.15 acres of land with an R-
15 zoning district; and
2. Request: Preliminary Plat consisting of 223 building lots and 27

D. Public Hearing Continued from February 19, 2019 for Villasport (H-
2019-0011) by Sadie Creek Commons, LLC, Located the SW
Corner of E. Ustick Rd. and N. Eagle Rd. - Approved
1. Request: Council Review of application H-2018-0121 and the
Planning and Zoning Commission's requirements related to
conditions of approval:
• UDC 11-4-3-2A.1, which requires all outdoor recreation areas
and structures that are not fully enclosed to maintain a
minimum setback of 100 feet from any abutting residential
d istrict;
• UDC 11-3A-13, which requires outdoor speaker
systems associated with the use to be located a minimum of
100 feet from all residential districts;
• UDC 11-4-3-2A.2, which prohibits outdoor event or
activity centers from being located within 50 feet of any
property line and limits the hours of operation to those
between 6:00 am and 11:00 pm;
• Condition #2.2, which limits the hours of operation of
the athletic club and spa to the hours between 4:00 am
and midnight (12:00 am) for indoor activities and 6:00 am
to 11:00 pm for outdoor activities, with outdoor music limited to
the hours between 9:00 am and 10:00 pm;
• Condition #2.10, which requires the Applicant to work
with Planning Staff and ACHD to create a crosswalk
for pedestrian access to the facility from the west parking lot.
