City of Meridian attention City Council Members H-2019-0068, Please submit the following to the City Council members for the 12-10-19 6:00 pm meeting as evidence in opposition of project H-2019-0068. Pictures from the weekend of Saturday November 2nd 2019 shows that a huge parking problem does exist on W. Apgar Creek Dr.and Lolo Pass Way do to parking overflow from the Selway Apartments located on Selway Rapids Dr. More pictures to follow. The parking overflows onto Apgar Creek Dr, Lolo Pass Lane and the fire hydrants and mail boxes are blocked and on occasion so are driveways. This exists because there is nowhere near enough parking for Selway residents and/or their guests. Something needs to happen to make a change and the answer is not a rezoning and adding 41 more town homes with the entrance and exit using Selway Rapids Dr adding to the already congested area. The corner of Goddard Creek Dr.and Apgar Creek Dr is so congested in the evenings and weekends a fire truck could not gain access to Apgar Creek in case of an emergency do to the crowded streets. No two cars can pass on Apgar in either direction and that's not how are streets were designed to operate. The streets are 20 wide and cars park right at the crosswalk next to or on the corner and should be 20' from the crosswalk or be ticketed per city code and they are not. Only tickets are written when a homeowner calls because the hydrants are blocked. This is known first hand speaking with Meridian PD after calls were placed. Apgar Creek Dr. has become an unsafe street for children to play outside do to the speeding and reckless driving. A parking study was done this year on Apgar and the speeds are not accurate do to the fact that the counter and speed meter was placed very close to a stop sign on Wild Goose and Apgar Creek Dr. This does not give an accurate reading because cars are just slowing down or just speeding up near the 3 way stop sign. As told by Kelly Creek hoa management Kelly Creek was forced to make Lolo Pass Lane not Way (a dead end) a fire lane and this just added more problems for residents and parking dilemmas. This should not have happened and is privately owned by the homeowners of Kelly Creek and is not city property. When the lane was marked it was done incorrectly and that also should be addressed because per city code you can't place metal sign posts in a sidewalk it is hazardous and is against code. The fire lanes are not marked at all and extent out onto Apgar Creek Dr. This needs to be reviewed and reevaluated before someone gets hurt. City code title 4-2-1 and Idaho Fire code 8.55.050 4-2-1: DEFINITIONS: GRAFFITI: Any inscription, work, figure, symbol, drawing, mark, or design that is marked, etched, scratched, drawn, or painted on any real or personal property or improvement, including, but not limited to, walls, fences, gates, pavement, buildings, rocks, trees, bridges, streets, sidewalks, and/or signs, whether such property is public, private, temporary, or permanent, without the consent of the owner of such property or the owner's authorized agent, and which inscription, work, figure, symbol, drawing, mark, or design is visible from any publicly accessible location. JUNK VEHICLE: Any vehicle, or parts thereof, which: A. Cannot be safely operated under its own power; 2 B. Is missing any one of the following: foot brakes, hand brakes, headlights, taillights, horn, muffler, rearview mirrors, windshield wipers, or adequate fenders; C. Has been declared salvage, or has been physically damaged to the extent that the cost of parts and labor minus the salvage value would make it uneconomical to repair or rebuild such vehicle; or D. Is otherwise in a wrecked, partially dismantled, inoperative, or dilapidated condition. This definition shall not include junk vehicles lawfully stored or parked pursuant to the operation of a lawfully conducted business, industry or commercial enterprise. NUISANCE: Anything which unreasonably injures or offends the health or senses; obstructs the free passage, comfortable enjoyment, or customary use of public or private property; or creates an actual or potential safety, health, or fire hazard. Nuisances shall include, but shall not be limited to, the following conditions designated as abatable nuisances and as general nuisances: It also impedes on Idaho fire code 8-55-050 marking 8.55.050 Marking. All designated fire lanes shall be clearly marked in one of the following manners: (1) Vertical curbs six inches in height shall be painted yellow on the top and side, extending the length of the designated fire lane. The pavement adjacent to the painted curbs shall be marked with block lettering a minimum of 18 inches in height and with a three-inch brush stroke reading: “No Parking – Fire Lane.” Lettering shall be yellow and spaced at no more than 50-foot intervals. (2) Rolled curbs or surface without curbs shall have a yellow six-inch-wide stripe painted extending the length of the designated fire lane. The surface adjacent to the strip shall be marked with block lettering a minimum of 18 inches in height and with a minimum three- inch brush stroke reading: “No Parking – Fire Lane.” Lettering shall be in yellow and spaced at no more than 50-foot intervals. Please consider these findings when you are considering your decision to rezone the already rezoned parcel in question. I appreciate your consideration regarding this matter.
