Dear Meridian Planning Department:
The above referenced CPAM and Rezone was approved by the Meridian City Council on August
21, 2018. A Development Agreement was entered into on January 23, 2007 and recorded on
February 15, 2007 as Instrument #107022431.
A CPAM and Rezone application was submitted for the four Franklin Road fronting lots and the
Staff Report stated that Staff would determine which sections of the Development Agreement
would require modification. This application is for the purpose of initiating the review and
modification of the DA which is a condition of the City Council Approval.
Attached you will find the warranty deed for the subject property, Affidavit of Legal Interest,
scaled vicinity map, pre -application notes, neighborhood meeting sign up sheet, commitment
of property posting, the confirmation of parcel verification and an application fee of $502.00.

Notes:
➢ Because these properties and those to the north (331,348, 251 264 143 & 152) were previously allowed to be zoned I -L
& C -G in the MU -C designation & deemed to be an appropriate mix of uses in the MU -C designation, Staff is hesitant to
support removal of the C -G zoning If approved there will no longer be a mix of zoning/uses, since the property to the
north (to the tracks) is all industrial Therefore staff recommends also including those properties in the FLUM amendment
to change the entire area to Industrial.
➢ Changing this site and that to the north to Industrial will reduce the overall MU -C designated area to 10+/- acres which
Till be difficult to develop as a mixed use project due to the long & narrow configuration of the land (a 310'+/- x 1435' +/-
area) with industrial uses to the east,
■ In order for Staff to be able to support the amendment to the FLUM staff recommends the applicant include the land to the north
(to the tracks) in the request for an amendment to the FLUM to the Industrial designation; and visit with the folks that own the land
to the west to explore an appropriate non -mixed use FLUM designation for those properties. If a consensus can be obtained, staff
recommends the applicant include those properties in the FLUM amendment request so that the proposed changes of the overall
area are cohesive and provide a better plan for the area long-term.

Note, A Traffic Impact Study (TIS) will be required by ACHD for large commercial projects and any residential development with over 100 units. To

The applicant shall post a copy of the public hearing notice of the application(s) on the property

The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.
