The Owners and Developer desire to redevelop the northwest corner of N. Main Street and E. Broadway Avenue, including two lots totaling 0.43 acres located at 703 and 713 N. Main Street in Meridian. A mixed-use four-story building with retail/commercial at street level and three stories of apartments located above is planned on Lots 2 and 3 of Renewal Place Subdivision, which was platted in 2013. The Renewal Place Subdivision plat created a 10' -wide public utility and drainage easement around the boundary of the subdivision, by Plat Note No. 7. A copy of the plat is attached for your reference (Exhibit B). The redevelopment plans call for bringing the new mixed-use building up to or near the subdivision boundary line. As such, we are requesting to vacate the existing public utility and drainage easement on Lots 2 and 3. A copy of the easement vacation legal description is attached (Exhibit A). A copy of the concept site plan is attached (Exhibit C). Modifications to the overhead and underground electrical and communication lines in the ACHD alley are currently in the design process. Any new easements that may be required for those utility modifications or new utility improvements will be addressed in the final design process and can be granted concurrent with this easement vacation request. You are requesting a response from Nampa & Meridian Irrigation District (NMID) regarding the relinquishment of an existing public utilities and drainage easement on the properties of 703 and 713 N. Main Street in Meridian Idaho. NMID has no facilities that it owns or operates at this location. However, there are private irrigation facilities that belong to the water users in the area. Those facilities should be addressed and or protected, to meet the concerns of fellow water users. Therefore, NMID will have no comment about the request for relinquishing this public utilities and drainage easement, as we have no district owned facilities in the area. Main Street and E. Broadway Avenue in downtown Meridian. A mixed-use four-story building with retail/commercial at street level and three stories of apartments located above is planned at 703 and 713 N. Main Street. We are proposing to vacate/relinquish a portion of an existing 10' -wide public utility and drainage easement. In order to vacate/relinquish the existing easement, the City of Meridian requires a public hearing. As part of the City process, relinquishment of easement letters are required from all applicable utilities and drainage districts. Please review the attached letter and exhibits showing the existing easement proposed for relinquishment/vacation. If there are any concerns, please contact me so that we may address them. If no concerns, please indicate Settlers Irrigation District's consent to the proposed easement relinquishment/vacation by signing the letter and/or by providing your form of relinquishment with the attached legal description.
