Description
Amendment to Comprehensive Plan Future Land Use Map: change land use
designation from Low Density Residential to Commercial
Annexation and Zoning: rezone from RUT (Rural to Urban Transit) zoning
district to a C-C (Community Business) zoning district for future addition
of a convenience store and fuel sales facility to the existing farmers market.

The Idaho Transportation Department (ITD) reviewed the referenced comprehensive plan amendment,
annexation, and rezone applications and has the following comments:
1. This project abuts the State highway system.
2. ITD has received an approach permit application from the applicant and is currently processing
their application. The proposed access aligns with the current US-20/26 and North Ten Mile
intersection as required by ITD and proposes the removal of the western existing approach.
3. ITD has received a traffic analysis for the Wagner Farms development. The traffic analysis is
scheduled May 24, 2019 for review by the Technical Engineer. ITD cannot determine what
mitigation is necessary without reviewing the provided traffic analysis. Once accepted, the traffic
analysis will identify what mitigation, if any, the applicant will be required to install to mitigate
for traffic impacts from their development.
4. Idaho Code 40-1910 does not allow advertising within the right-of-way of any State highway.

5. The Idaho Administrative Procedures Act (IDAPA) 39.03.60 governs advertising along the State
highway system. The applicant may contact Justin Pond, Right-of-Way Section Program
Manager, at (208) 334-8832 for more information.
6. The City is reminded that the US-20/26 corridor is already congested. This project will increase
the number of vehicle trips in the corridor. As the City continues to add additional trips to the
corridor through development, the congestion will worsen until the roadway system is ultimately
overloaded and fails.
7. Provided the necessary traffic mitigation has been installed and the appropriate ITD permit has
been obtained, ITD does not object to the proposed application as presented.
