MODIFIED DEVELOPMENT AGREEMENT
A Request for Reconsideration dated December 17, 2018 of the above -captioned matter by the
appellant was properly filed pursuant to MCC: Title 1, Chapter 7, Section 10.
The City Council scheduled the request to be considered at its regularly scheduled meeting on
February 6, 2019 and provided Notice of such to the appellant.
The City Council considered the written request and REMANDED its decision for Revised Findings
of Fact, Conclusions of Law, and Decision and Order and for a Finalized Modified Development
Agreement dated December 4, 2018.
The revised Findings of Facts, Conclusions of Law, Decision, and Order and the final Modified
Development Agreement will be submitted for Final Approval at a later date.
An affected person aggrieved by the final decision in this matter may seek judicial review as
provided by chapter 52, title 67, Idaho Code.
By action of the City Council at its regular meeting held on the 6th day of February 2019.
