Thank you for keeping us in the loop on the crossing. Relating to the adjacent storage unit project, we have been
talking with Mike and Ryan about the project regarding the crossing and they informed me of some of the
constraints on their project. I understand there is currently a proposed limitation on renting the storage units to the
public. While I understand the use as an accessory, I believe that local residents, in addition to the Silver Oaks'
tenants, would benefit from such use. I would think that offering storage to others, including our future residents (if
our project obtains approval), would also provide a huge benefit.
Should it help in any discussions regarding allowing use by others than Silver Oaks' tenants, we would support the
City's decision to offer rentals to the public.

Sonya,
I spoke with Ryan Montoya today regarding the crossing over the Kennedy Lateral. It is my understanding that
neither ACHD or Meridian City is requiring them to construct a crossing over the Kennedy lateral for their
development. If that assumption is correct then we are fine not requiring them to participate in the cost of
constructing the crossing. I also discussed this with Dennis Fulcher, a representative of the land owners, and he
agreed with me that he will not request a cost-sharing agreement so long as Ryan's group is not required to install
the crossing.
I appreciate you and the city making us aware of the situation, and allowing us to work it out with Ryan and Mike.

Great, thank you. Our storage project is not required to install the crossing. The extent of any requirement was/is
the contribution for the road trust. I have attached the City's Recommendation which discusses this on page 5 (H),
page 7, B(d) and (e), page 11. The revised requirements from ACHD are also attached.

Thanks for sending the below information to me. I just spoke with Dennis Fulcher, a representative of the land
owners, and he is fine waiving any reimbursements for the crossing of the Kennedy Lateral so long as your group is
not required to install the crossing. Please confirm that ACHD and/or Meridian City is not requiring that you install a
crossing over the Kennedy Lateral. Upon receiving your confirmation, I will send an email to Sonya Allen at Meridian
City letting her know that we have discussed the matter and are not requesting any reimbursements for the crossing
from you.

Thank you for the call today. Again, sorry for any miscommunication on our end. Attached is the original letter from
ACHD requiring us to contribute $14,300 to a Right -of -Way Trust Fund (see A2). It is my understanding that the
$14,300 was considered to be our proportionate share of the total, which is estimated at $52,000. It also
acknowledges the expiration of the road trust requirement from the Silver Oaks Apartments. I have also attached
the email from Stacey of ACHD regarding the fact that they would not be requiring us to contribute.
Please let me know if there is anything else I can provide. I hope that we both get our projects approved. Again, any
feedback you can provide to the City regarding our use and support of your customers will be greatly appreciated.
