Thank you for providing us with details regarding the updated Linder Village plans (copy attached for
reference) and the inclusion of a new collector road ("New Collector") that will connect North Linder
Road to North Fox Run Way through our collective properties. At your request, Brighton is providing
written confirmation regarding the alignment of the future New Collector road:
1. Brighton Investments, LLC, an affiliated entity of Brighton Corporation, is the owner of Parcel
No. 50425120902, which is adjacent to North Fox Run Way and the Linder Village Development.
2. Brighton acknowledges that the New Collector provides a backage road connection that
parallels Chinden Boulevard that will provide long-term benefit to the community, and that the
New Collector will be constructed concurrent with Linder Village's Phase 1 improvements.
3. The right-of-way for the New Collector is undetermined but is generally understood to be
between 60 and 70 feet to comply with ACHD design standards, excluding any required
landscape buffer to existing residential properties.
4. Brighton agrees to work with ACHD on the alignment and right-of-way acquisition to facilitate
the construction of the New Collector. The purchase price of the right-of-way is to be
determined. The alignment of the new collector shall be coordinated so as not to interfere with
the access to the Veranda and Cadence properties on the east side of Fox Run.
S. The New Collector through Brighton's property will be adjacent to existing residential homes,
and Brighton will require that a landscape buffer of the existing, mature vegetation be
maintained in a horizontal dimension of 25 feet to 30 feet from back of future sidewalk.
One additional matter to be addressed with the improvements to SH 20/26 and the New Collector
connection to Fox Run Way is the Paramount community monuments at the intersection. We recognize
that a fly -over monument as currently exists may not be practical with the expanded intersection and
signal design. However, it is important that the entry monument be replaced or reconstructed in a
manner consistent with the general character of the existing monuments so that the community's
identity is maintained. Please detail for us your plans on how this will be accomplished concurrent with
the roadway improvements.
