It is my understanding that neither ACHD or Meridian City is requiring them to construct a crossing over the Kennedy lateral for their development. If that assumption is correct then we are fine not requiring them to participate in the cost of constructing the crossing. I also discussed this with Dennis Fulcher, a representative of the land owners, and he agreed with me that he will not request a cost-sharing agreement so long as Ryan's group is not required to install the crossing. I appreciate you and the city making us aware of the situation, and allowing us to work it out with Ryan and Mike. Please let me know if you have any further questions. Have a nice weekend. Our storage project is not required to install the crossing. The extent of any requirement was/is the contribution for the road trust. Again, sorry for any miscommunication on our end. Attached is the original letter from ACHD requiring us to contribute $14,300 to a Right -of -Way Trust Fund (see A2). It is my understanding that the $14,300 was considered to be our proportionate share of the total, which is estimated at $52,000. It also acknowledges the expiration of the road trust requirement from the Silver Oaks Apartments. I have also attached the email from Stacey of ACHD regarding the fact that they would not be requiring us to contribute. Please let me know if there is anything else I can provide. I hope that we both get our projects approved. Again, any feedback you can provide to the City regarding our use and support of your customers will be greatly appreciated.
