ELEVATE FRANKLIN STORAGE
REZONE AND DEVELOPMENT AGREEMENT MODIFICATION
Ten Mile Development, LLC (Graye Wolfe), hereby applies for a rezone of 3.53 acres from
Limited Office (L -O) to Medium-high Density Residential (R-15), along with a development
agreement modification to facilitate the construction of an accessory use self -storage facility
located adjacent to The Franklin at Ten Mile Apartments.
Platted as Lot 1, Block 1, Umbria Subdivision, the lot is located at the northwest corner of N.
Umbria Hills Avenue and W. Franklin Road in Meridian, Idaho. This lot was formerly proposed
and approved as a commercial/office lot in 2005.
History of Previous Actions:
In 2005, the entire 28.6 -acre property was granted Annexation and Zoning (AZ -05-016) approval
by City Council with R-15 and L -O zoning districts. Concurrently, a preliminary plat (PP -05-
023) consisting of 1 large multi -family residential building lot and 1 commercial office building
lot was approved. On January 3, 2006, the Meridian City Council approved the Development
Agreement, which was recorded on January 6, 2006, as Instrument No. 106002636. The
property was annexed under Ordinance No. 06-1209. On March 21, 2006, the final plat
(FP -06-011) for Umbria Subdivision was approved by the Meridian City Council. The Meridian
City Council waived the requirement for the applicant to the the Kennedy Lateral.
On February 15, 2011, Council approved a conditional use permit (CUP -10-014) for a multi-
family development consisting of 369 dwelling units on 24.61 acres of land in an R-15 zoning
district. An amendment to the development agreement (MDA -10-011) was also approved based
on the new development plan (Inst. #111028916), and Silver Oaks Apartments (marketed as The
Franklin at Ten Mile) is nearly complete.

Project Description:
The subject property lies within the Ten Mile Interchange Specific Area Plan (TMISAP). The
Future Land Use Map (FLUM) contained in the TMISAP designates the property as Medium-
high Density Residential (MHDR). The TMISAP encourages a broad range of uses in close
proximity to one another, including uses beyond those specifically defined within the Ordinance.
The proposed storage facility, adjacent and accessory to the apartment complex, falls within the
mixed, complementary uses as described within the TMISAP. The TMISAP highlights diversity
of building forms and neighborhood -serving retail and service uses. The applicant believes the
proposed accessory use meets the test of integration of multiple income-producing uses as
outlined in the Plan.
Rezoning the property from L -O to R-15 will allow an enclosed self-service storage facility to be
constructed as an accessory use to the large existing apartment complex. The apartments were
constructed in three consecutive phases and have been very successful. Many residents have
expressed an interest in having storage units available. This blending of uses will benefit the
apartment facility.
The existing development agreement in effect for this parcel requires that a conditional use
permit be submitted for any use on the property. Professional offices and a daycare were
previously considered for the site; the need for a nearby storage facility is now a priority. The
applicant is requesting that a new development agreement with new conditions of approval be
entered into as a condition of the rezone and that the property be removed from the existing
development agreement. Signatory to the agreement will be Graye H. Wolfe, Sr., Manager of
Ten Mile Development, Inc., 1409 N. Main Street, Suite 109, Meridian, Idaho 83646.
The storage areas will be surrounded by a solid masonry wall with architectural features to
provide articulation and break up the expanse of wall. Great care was taken to create an
architectural focal point at the Franklin Road and Umbria Hills intersection. Extensive
landscaping will be provided around the exterior and along the Franklin Road frontage as shown
on the attached landscape plan. Access will be taken from W. Perugia Street, with emergency
access only to N. Umbria Hills Avenue. This is consistent with the TMISAP, which discourages
access to arterials and collectors if local street access is available. The developer will be
requesting approval to install signage for the apartment complex on the exterior corner of the
storage facility. Hours of operation will be from 6:00 a.m. to 11:00 p.m., as provided for in
Meridian City Code.

• Rezone to R-15 consistent with MHDR FLUM designation: the use/design (typically) is not consistent with the
TMISAP for the MHDR FLUM designation (see TMISAP pqs 3-6 - 3-7) - include in narrative why you think it is consistent.
• Accessory storage for the existing apartment complex is ONLY allowed to serve the residents of the apartment complex in the
R-15 district: a stand-alone storage facility for the general public is prohibited.
• A modification to the DA is required to modify the previously approved site plan and use (office/daycare)
• The DA requires a CUP prior to development; either apply for a CUP or modify the DA to remove the CUP requirement.
• Comply with the specific use standards listed in UDC 11-4-3-34 Self -Service Storage Facility
Note: A Traffic Impact Study (TIS) will be required by ACHD for large commercial projects and any residential development with over 100 units. To
avoid unnecessary delays & expedite the hearing process, applicants are encouraged to submit the TIS to ACHD prior to submitting their application

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11 -5A -5D, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.
