PLANNING DIVISION 1.1 Development Agreement 1.1.1 The applicant will comply. 1.2 Site Specific Conditions of Approval (numbering from staff report is off) 1.1.1 Understood. a. The applicant will connect the existing home (Lot 3, Block 5) to city utilities prior to signature on the final plat within which the specific home lies. b. The common driveway shown as Lot 13, Block 3, will end at 150 feet; the remainder of the lot serves as a sewer easement to serve adjacent property. We have contacted the Meridian Fire Department, and they do not have an issue with the driveway as long as it is 150 feet or less; if the driveway were to extend beyond 150', the homes on the driveway would be required to have fire sprinklers. c. A setback exhibit for the lots fronting the common driveway will be provided with the final plat application. d. Understood. 1.1.2 Landscape plan dated 7/24/18: a. The Settler's Irrigation Districts will not allow trees to be planted within their easement. The applicant is retaining the existing large spruce trees within the building lots on the north and within the common area on the east boundary to meet the minimum requirement. The applicant will install the multi -use pathway within Lot 22, Block 3 and Lot 31, Block 5, along with turf, sprinklers and shrubs. Since these lots are encumbered by a Settlers Irrigation easement, we cannot install additional trees. In my discussion with Settlers, the existing trees may remain, but new trees will not be allowed. The area was counted as part of the eligible open space. c. Existing trees are being retained on site to meet the minimum landscape requirements, as planting of trees within the irrigation district easements will not be allowed. d. The applicant will comply. e. Fencing will be provided and meet all requirements for adequate visibility of common areas. f. There is existing landscaping across the frontage of 5136 W. Cherry Lane. However, an existing driveway is also located within the 25 feet for access to the existing garage oriented to the south. The applicant will provide an easement as requested. g. Landscaping for the multi -use pathways will be as shown on the approved landscape plan. The existing spruce trees being retained meet/exceed the minimum landscape requirements. Alternative Compliance may be necessary to satisfy the irrigation district and comply with the UDC. h. PARKS DEPARTMENT 6.1 The 10 -foot -wide multi -use pathway will be constructed south of the Settlers Canal and along the eastern boundary of this development; the developer will install a 10 - foot -wide path within the new right-of-way along the frontage of 5136 W. Cherry Lane and within Lot 1, Block 1. No off-site pathways will be provided. 7. ADA COUNTY HIGHWAY DISTRICT CONDITIONS OF APPROVAL: The applicant will comply with ACHD's conditions of approval and receive plan approval prior to starting construction.
