Alturas 1550 Tech Lane, LLC (the "Applicant") is pleased to provide you with the enclosed
rezone application for the property located at 1550 S. Tech Lane and legally described on the
attached Exhibit A (the "Property").
As you may be aware, we have been in discussions with City Staff over the course of several
months regarding the Applicant's acquisition of the Property and its future use. It was
suggested during the course of these meetings that the Applicant explore a rezone from I -L
(light industrial) to C -G (general retail and service commercial). C -G is consistent with not only
the comprehensive plan, but also the uses that have arrived in the immediate vicinity of the
Property and the types of tenants who have found the Property desirable.
The Applicant has ultimately agreed with City Staff's suggestion and is, accordingly, making
this application for rezone.

At this time, no changes to the site plan are requested, so only a rezone application is submitted.
Future site plan changes, if any, will be submitted via CZC application.
One priority of the City has been to formalize cross -access with the Property's neighbor to the
east. In connection with that matter, the Applicant has previously (at staff's direction) recorded
a cross -access easement that is contingent on a reciprocal cross -access being provided by that
neighbor. The Applicant is currently in discussions with the neighbor for a re -design of that
entrance. Per discussions with Bill Parsons, that re -design will require a CZC approval that
may precede this rezone application.
If a development agreement is required in connection with this rezone, we suggest the
following language would be appropriate for inclusion: (1) confirmation that the prior
entitlements associated with the Property are no longer applicable (as concluded by the City
Attorney); and (2) permitted uses at the Property will continue to have use of the loading docks
that currently exist on the east and west sides of the building located at the Property.
Conclusion
We appreciate the City's efforts in discussing the Property to date. We look forward to
continued work with staff as this matter proceeds to hearing.

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11 -5A -5D, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.
I am aware of the above requirements and will comply with the posting requirements as stated in
UDC 11-5A-5.
