I will bring these items up to the council tonight. 1. Condition 1.1.1d states, “The access to the commercial parcel shall be from Waverton Drive. Direct access to Black Cat shall not be permitted with this development.” We would like to keep the access to Black Cat as proposed and is approved by ACHD in their staff report dated July 12, 2018 as a right-in/right-out only driveway access. 2. Condition 1.1.3d states, “Provide a 6-foot tall solid fence and noise abatement, in accordance with UDC 11- 3H-4D, along Chinden Blvd.” “This is only applicable adjacent to the residential frontage to Chinden Blvd.” I agree to provide the noise abatement requirements stated in code UDC 11-3H-4D for the residential portion but I don’t believe an additional 6-foot solid fence is necessary. If the 6-foot fence referenced in the condition was intended for the commercial lot frontage, then I request the 6-foot tall solid fence requirement be removed because I don’t intend to install a fence in that portion of the Chinden frontage.
