Josh,
I reviewed the staff report and noticed a couple items that I have questions and concerns about. I missed them in
the prior staff report:
Item 1.1.1d – We have always planned and discussed having direct access to Black Cat for the commercial lot. ACHD
approved this access point as a right-in/right-out only. I propose the City’s condition be the same as ACHD’s
condition.
Item 1.1.3d – I don’t remember discussing the requirement for a 6’ tall solid fence and noise abatement along
Chinden. The code referenced states “the applicant shall provide traffic noise abatement by constructing a berm OR
a berm and wall combination…”. And it “shall be a minimum of 10’ higher than centerline”. I will meet the code by
installing a 10’ berm BUT I am confused by the wording of the condition. Can you please clarify the intent of the
condition or if it was an error. By the way, the wall’s installed by Olive Tree at Spurwing should never be allowed,
ever. Ugly!
