Josh and Jarron,
Two remaining changes. I noted them on the attached – see the noted dated 8-6-18. One is a reference to the old
landscape plan and whether the new one corrected the issue and the other is deleting a reference to the pedestrian
pathway to the church that the church wanted to remove and the Council and P&Z were ok with. The condition
itself has been corrected.

Again there are a number of corrections I think Josh needs to make to the proposed findings. See my
attached notes on the documents. I will hit the highpoints below.
FINDINGS CONCLUSIONS AND OPRDER

Section A. The Findings reference the staff report as providing the facts and the basis for the decision. The
facts section and analysis sections in the staff report were not updated to reflect the updated preliminary
plat and landscape plan.
Section B.7. It has the wrong date for the staff report – should be July 24
Section C. This language has the Council DENYING your request. Obviously this should be an approval.
STAFF REPORT
Looks like he got the changes to the conditions corrected.
The Comprehensive Plan section still references the old plat with connections to Lake Hazel and the
requirement for an emergency access. If he doesn’t want to delete and correct these references he should at
least note that the applicant submitted an updated plat and landscape plan. The findings reference and
adopt the staff report as providing the facts and analysis that support the decision and it should reflect what
was submitted most recently as that was important in obtaining approval. These conflicting references
cause confusion now and would be worse in the future.
They included the condition about seeing if the turnaround is really needed which is good. If the
turnaround is required, there is no reference to the ability to include remediation of the turnaround in the
DA and put the responsibility on the developer and then the HOA once the turnaround is no longer
needed. The record is clear on the audio/video we just need to make sure that is in the DA.
