Proposed uses for the property include a Bluebird Car Wash facility, future retail store and office space. The applicant is also submitting a miscellaneous application to establish the development standards in lieu of a development agreement. Located north of Overland Road and west of S. Silverstone Way, north of the Silverstone Subdivision, the property was annexed in 1995 under Ordinance No. 719 and given a zoning designation of C -G. The Ordinance contained a condition of annexation that the developer enter into a development agreement. The Annexation Ordinance specified "the development agreement shall include within the development of the property the requirements of 11-9-605 C, G, H2, K and L of the Revised and Compiled Ordinances of the City of Meridian." Since the sections referenced in Ordinance 719 relate to the zoning ordinance in effect 23 years ago, it is apparent that implementation of such sections should not and could not apply in 2018. Therefore, after meeting with staff it was determined a miscellaneous application would be appropriate. The applicant respectfully requests the specific site plans within the project be evaluated through the Certificate of Zoning Compliance and design review processes. The project known as the I-84 Power Mall by Langly Associates, Inc., included the land from Overland Road to I-84 and was submitted as a planned commercial development as outlined in Ordinance 719, but the project never came to fruition and the conditional use expired. In 2013, Engineering Solutions, LLP, was retained by James Kissler, LLC to submit application to the City of Meridian for a property boundary adjustment allowing for the construction of S. Silverstone Way. The City determined the Anderson and Kissler properties met the test of a parcel of record (April 2, 1984) and approved the boundary adjustment. The adjustment provided public street frontage to Overland Road for the future street serving the Norco facility. The facility has been constructed and a commercial street, S. Silverstone Way, has been completed and landscaping installed along the roadway. The applicant is requesting that the three building permits be issued on the property prior to recording of the final plat. The owners of Bluebird Car Wash have met with staff and are ready to submit building plans within the next couple of months. Sewer and water has been stubbed to the site with the construction of S. Silverstone Way to serve the Norco development. Sidewalks, curb cuts and landscaping were installed with construction of S. Silverstone Way. A portion of the Five Mile Pathway has been constructed as part of the Norco project, north of Five Mile Creek. Appropriate cross -access and utility easements will be dedicated with development of each proposed lot, as detailed driveways, parking lots and buildings have not been finalized. Staff indicated that a cross -access easement between the subject property and the S -Sixteen property located on the west side of Eight Mile Creek will be required. The applicant has reviewed the development agreement for the S -Sixteen property. The agreement reads: "The applicant shall provide a stub street or drive aisle to the east on the subject property, near Pad C on the narrow section of the Eight Mile Creek within the cross -access range shown on the revised site plan in Exhibit A.2. A bridge connection over the creek is not required to be constructed by the subject property owner." S -Sixteen will have vehicular interconnectivity north across Five Mile Creek via Rackham Way. This will provide the connectivity into the Norco property and access to S. Silverstone Way. Eight Mile Creek is a natural waterway that includes a floodway and floodplain. Therefore, minimizing vehicular crossings and their impact on the wetlands and natural habitat is preferred. The applicant objects to cross -access considering the natural waterway divides the property and a bridge was installed with S. Silverstone Way providing the necessary interconnectivity. The project is in conformance with all requirements and provisions of the UDC and conforms to acceptable engineering, architectural and surveying practices and local standards. OF PARCEL.
