Description
Replacement of existing development agreement with a new agreement to
accommodate the proposed residential development plan
Amend the future land use map contained in the comprehensive plan to change
land use designation from commercial to medium high density residential
Rezone from C-G to R-15 and R-40 zoning districts
Preliminary Plat to construct a subdivision consisting of 399 residential
dwelling units and 18 common lots
Conditional use permit allowing multi-family development consisting of 272
dwelling units in the R-40 zoning district

The Idaho Transportation Department (ITD) reviewed the referenced Comprehensive Plan Future Land Use
Map Amendment, conditional use permit, development agreement modification, rezone, and preliminary plat
applications and has the following comments:
1. This project abuts the State highway system.
2. I-84 is a full access controlled highway. No access to the State Highway system is requested with
this application and none is approved. The interstate fence is typically constructed one foot within
ITD Right Of Way, but may vary due to terrain and other possible issues. All measurements
relative to ITD Right of Way shall be taken from the Right of Way monuments, not from the
fence.
3. Documents provided with this application indicate that a Traffic Impact Study (TIS) was
completed and submitted to ACHD. ITD requests a copy of the traffic impact study to review for
impacts to the I-84/ Meridian Road interchange.
4. The City is reminded that the I-84 corridor is already congested. This project will increase the
number of vehicle trips in the corridor. As the City continues to add additional trips to the corridor
through development, the congestion will worsen until the roadway system is ultimately
overloaded and fails. ITD has no current funding assigned to mitigate traffic congestion in the I-84
corridor in this area.
5. Idaho Code 40-1910 does not allow advertising within the right-of-way of any State highway.
6. IDAPA 39.03.60 rules govern advertising along the State highway system. The applicant may

7. ITD objects to the proposed application due to traffic concerns. ITD will withdraw any objection
to the proposed application once all traffic concerns have been addressed with ITD Staff.
