The two deeds referenced by Doug Jayo are in the correct place, but I am concerned with the wording in the deeds
(“subject to a 30 feed road right-of-way on the South”). Without a specific cross-access easement as required by the
UDC, I am concerned that the property owner to the East could potentially close off access because of the lack of
specificity in the grant, and the increased density brought by this application. I recommend that you require cross-
access easements as a condition of approval . This will require a specific legal description and map from Jayo, and from
parcel S1212120690. I can send a legal form to Doug if he wants help with that. Don’t we really need two easements
(one from Jayo and one from S1212120690?) Also, look at the configuration of the two lots to the south, adjacent to
NW 4 th : It looks like the one in the middle is a flag lot and the one on 4 th is served by 4 th , so is it correct to say that the
common driveway already serves 4 homes? (I’m reading from the pre-app notes).

I don’t know about the 30 roads…
One covers 2 parcels and the other covers one of the first 2 parcels. Either way. Here are the maps.

When you have a chance, could you please review this document and let me know if there is a cross-access easement in
it? I'm not seeing it....I told them to submit an easement for the highlighted parcel for access via NW 4th St. across the
adjacent properties.
