The Idaho Transportation Department (ITD) has reviewed the annexation, zoning, and conditional use permit
application by ALC Architecture requesting the annexation and zoning of a parcel with an C-G Zoning
District as well as approval to construct a drive-through Fast Eddy’s establishment within 300 feet of a
residential use with extended hours of operation in the C-G Zoning district of 24 hours a day/ 7 days a week.
The site is located at 3775 North Eagle Road, west of SH-55 (N. Eagle Rd.) milepost 39.29. ITD has the
following comments:
1. This project abuts the State highway system.
2. ITD has identified several specific concerns to include turning movements, storage lengths,
deceleration lanes, and a 12 foot setback for future widening. These concerns have been
communicated to the developer via email in previous communication and developer is addressing
the concerns.
3. Idaho Code 40-1910 does not allow advertising within the right-of-way of any State highway
system.
4. IDAPA 39.03.60 rules govern advertising along the State highway system. The applicant can
contact Justin Pond, Program Manager for ITD’s Headquarters Right-of-Way Section at 334-8832
for more information.
5. The City is reminded that the SH-55 (N. Eagle Road) corridor is already congested. This project
will increase the number of vehicle trips in the corridor. As the City continues to add additional
trips to the corridor through development, the congestion will worsen until the roadway system
ultimately is overloaded and fails. ITD has no current funding assigned to mitigate traffic
congestion in SH-55 (N. Eagle Road) corridor in this area.
6. ITD does not object to the proposed annexation, zoning, and conditional use permit applications
provided all traffic and access concerns have been addressed with ITD Staff.
